  1. The Government of Kenya has obtained a loan from the Hungarian Government through the Exim Bank of Hungary for theDesign, Build/Construction, Equipping and Commissioning of a Comprehensive Cancer Management Centre Located at Dedan Kimathi University of Technology and it is intended that the entire tied-aid -credit Financingwill be applied towards the costs of the Design, Build, Equipping and Training of Staff under a Turnkey method.
  1. The University invites sealed Tenders from eligible Tenderer’s in the form of either Joint Ventures or consortiums comprising of Registered Companies of strictly Hungarian and Kenyan Nationality Only for the Design, Construction, Equipping Commissioning and training of staff for aComprehensive Cancer Management Centre at Dedan Kimathi University of Technology (herein after called the Works) and the remedying of any defects therein.
  1. Eligible interested Tenderers may obtain further information, addendums or clarifications in respect to this Tender from the University’s website dkut.ac.ke. All eligible Tenderers are advised to regularly check the website during the bidding period.
  1. A complete set of the Tender documents may be downloaded from the University’s website dkut.ac.ke or public procurement information portal: www.tenders.go.ke, free of charge.Eligible Tenderers downloading the Tender document MUST forward their company’s details to:procurement@dkut.ac.ke so that any addendum/ clarifications can be sent to their email address.
  1. Any requests for clarification to be sent either byordinary mail to The Vice Chancellor, Dedan Kimathi University of Technology Nyeri, Kenya through the address indicated herein, or through email addressprocurement@dkut.ac.ke. Prospective bidder may at any time, but not later than 21 days before the closing date for submittal of bids, request.
  1. The Lead partner of the Joint Venture or Consortium working with the Main Contractor may invite eligible subcontractors, joint venture partners or suppliers participating through this document to form part of his Tender. All partners of the joint venture or consortium shall be liable jointly and severally for the execution of the contract in accordance with the contract terms. A copy of the agreement entered into by the joint venture partners or consortium shall be submitted with the tender. The Lead partner and Building Contractor will take the lead and be responsible for the building works sub-contractors or joint venture partners and will arrange for the mandatory Tender Security.
  1. A compulsory Site Visit will be held at the site located opposite Dedan Kimathi University of Technology along the Nyaribo-Chaka Highway on Friday, 20th May,2022 from 9:00 a.m. to 5:00 p.m.
  1. The contractor will be required to review preliminary designs, develop final designs for the employer’sapproval, and develop the detailed bills of quantities and nominated suitably qualified Joint Venture partners or sub-contractors. 
  1. This is a Two Envelope Procedure, Envelope 1, Technical and Envelope 2, Financial (Priced Bill of Quantitieseach in a separatesealed envelope with all the pages numbered serially. In the event the Tenderer does not pass the Technical Evaluation, the Financial Proposal (Priced Bill of Quantities) shall be returned unopened.
  1. The original and one copy of the Technical Proposals, Envelope 1 shall be placed inside of a sealed envelope, including a soft copy in CD ROM or flash disk, clearly marked “TECHNICAL PROPOSAL”, “[Name of the TENDER] “, reference number, name and address of the Tenderer, and with a warning “Do Not Open until Monday 13th June, 2022 at 00 Noon. (KenyanTime) the time of the Technical Proposal submission deadline].”
  1. Similarly, the original and one copy Financial Proposal Envelope 2, shall be placed inside of a sealed envelope, including anencrypted/password protected soft copy in CD ROM or flash disk, clearly marked “FINANCIALPROPOSAL” followed by the Tender Name, Tender Number, name and address of the Tenderer, and with a warning “Do Not Open With The Technical Proposal.” The Tenderer will be requested to send the Keyword/Password after passing and receiving marks for the technical evaluation.
  1. The sealed envelopes containing the Technical Proposal (Technical Proposal only) - Envelope 1, and Financial (Priced Financial Proposal) - Envelope 2 Proposals shall be placed into one outer envelope and sealed. This outer envelope shall bear the submission address, Tender Number and Tender Name and shall be clearly marked “Do Not Open Before12:00 Noon. Monday 13th June,2022.”. TheTenderer’s name and address should not appear on this outer envelope.
  1. If the envelopes and packages with the tenders are not sealed and marked as required, the Procuring Entity will assume no responsibility for the misplacement, loss, or premature opening of the tender.
  1. The Tender must be accompanied by a Tender Security (Bank Guarantee) ofUSD 17,500or equivalent amount in the currency of the Tender.
  1. Tenders must be delivered to the address below,

The filled Document will be  deposited in the Tender Box provided at the ground floor  entrance to the Resource Center II so as to be received on or before Wednesday 4th May, 2022 at 10:30 am Kenyan Time. Tender documents shall be opened immediately thereafter in the presence of Interested bidders or their representatives who choose to attend at the 2nd Floor Resource Centre II Dome where only one representative per bidder shall be allowed into the room.

 

  1. Technical Proposals will be opened immediately thereafter at the Resource Centre II Lenana Hall located at the Second Floor Resource Centre II Dedan Kimathi University of Technology Main Campus situated along the Nyeri-Nyahururu road.
  2. A financial opening of the financial bids will be held after the completion of Technical Evaluation and bidders will be notified to attend.

  3. The contract agreement will only be effective upon clearance and entry into force of the Project Financing Agreement. Otherwise, if the Project Financing Agreement does not come into force, the contract agreement shall be deemed null and void and neither party shall have the right to claim any compensation or damages.
